 Terms of Service - Description

LAWN CARE SERVICE AGREEMENT

1.0 CONTRACTOR RESPONSIBILITIES
Azalea Outdoors LLC ("Contractor") agrees to provide lawn care services which may include, but are not limited to fertilization, weed, insect, and disease treatments.
Contractor shall perform services per the terms in this Agreement. Contractor reserves the right to update this Agreement if:
• Local/state/federal regulations change
• The layout of the property changes (see Section 3.1A)
1.1 Workforce
All employees will be qualified, trained, and legally authorized to work in the U.S.
1.2 Materials and Licensing
All materials will meet applicable standards. Contractor shall maintain appropriate licenses for chemical applications.
1.3 Bio-Hazards
Contractor is not responsible for cleaning or disposing of biohazardous materials (e.g. needles, waste, carcasses). Contractor will notify Client of hazards observed.
1.4 Licenses and Permits
Contractor will obtain and maintain licenses and permits required by law.
1.5 Taxes
Contractor will pay all applicable business and material taxes.
1.6 Insurance
Contractor shall maintain liability, vehicle, and workers’ comp insurance.
1.7 Limitation of Liability
Contractor shall not be liable for damages unless caused by direct negligence.
1.8 Invoicing and Additional Work
Invoices will reflect agreed pricing. Extra work not covered by this Agreement will be billed separately.
1.9 Notice of Defect
If a repair or correction requires more than five (5) business days, Contractor will provide written notice.
1.10 Right to Terminate Services
Contractor may terminate this Agreement:
• For nonpayment (after 10-day written notice)
• For confrontational or threatening behavior toward staff
• For any reason with 10-day written notice

2.0 CLIENT RESPONSIBILITIES
2.1 Property Access
Client shall provide access to all service areas during business hours or as otherwise arranged.
2.2 Payment Terms
Client shall approve service estimates via e-signature. Work can be scheduled once one of the following payment arrangements is confirmed:
Select One:
• Card on file. On job completion, the card on file will be charged for services.
• Prepayment. Payment for upcoming services is required before they are scheduled.

Checks payable to: Azalea Outdoors LLC
Returned check fee: $45
2.3 Damage Reporting
Client must promptly inform Contractor of any damage caused to Client's property. Contractor will attempt resolution within 2–5 business days unless weather, seasonality, or product availability delay response.
2.4 Irrigation
Client is responsible for weekly watering (1"-1.5" total moisture). Contractor is not liable for issues caused by drought, overwatering, or irrigation failure. Client to follow UF IFAS lawn care guidelines.
2.5 Pet and Waste Policy
It is required that pets be secured, and any waste be removed prior to service. Areas with animal presence may be skipped but still billed.

3.0 GENERAL TERMS
3.1 Term and Pricing
This Agreement is valid from time of acceptance to cancelation. Rates will remain fixed unless:
(A) Property layout changes (e.g., fencing, landscaping)
(B) Services paused for over 30 days or with delinquent payments may face rate adjustments.
(C) Market conditions demand. Client will receive 30 day notice.
3.2 Scheduling Disclaimer
Due to weather conditions and routing logistics, the Contractor is unable to guarantee specific times or dates for service.
3.3 Late Payment Policy
Past due accounts result in delayed or suspended service.
3.4 Cancellation Policy
Client may cancel:
• Within 30 days of signing
• With 30-day notice if Contractor fails to meet terms
• With 30-day written notice prior to renewal.
3.5 Renewal Clause
In the absence of a cancellation notice, this Agreement shall automatically renew.
3.6 Assignment
An agreement can be transferred:
• By Client to a new homeowner/tenant
• By Contractor to another licensed lawn care provider
